Privacy policy statement

These Terms of Service (“Terms”) govern your access to and use of GAO Internet websites, documentation, APIs, SDKs, dashboards, gateway services, network services, and related offerings (collectively, the “Services”). The Services are operated by Toii Labs LLC (Delaware, USA) (“Operator”, “we”, “us”).

BY USING THE SERVICES, YOU AGREE TO THESE TERMS.

1. Who you are contracting with

You are contracting with Toii Labs LLC. If you use the Services on behalf of an organization, you represent you have authority to bind that organization, and “you” refers to that organization.

2. Definitions

  • “GAO Internet”: a unified infrastructure stack (including a browser component, gateway services, and network services).
  • “Customer”: a business or developer using the Services.
  • “End User”: an end user of a Customer’s application.
  • “Node Operator”: a person or entity operating compute/storage/relay resources used by the Services.
  • “Content”: any data or materials transmitted, processed, or stored via the Services (including by Customers and End Users).

3. Service description; no warranties about third-party networks

The Services may interoperate with third-party networks, blockchains, wallets, and providers. We do not control third-party services and are not responsible for them.

Some features may be labeled beta/preview and may change or be discontinued.

4. Acceptable Use

You must comply with the Acceptable Use Policy (AUP). If you violate the AUP, we may suspend or terminate your access.

5. Accounts, API keys, and security

  • You are responsible for safeguarding credentials, keys, and tokens.
  • Do not embed secrets in client-side code.
  • Notify us promptly if you suspect compromise.
  • We may rotate, revoke, or disable credentials to protect the Services.

6. Customer responsibilities (Developer/Business)

You are responsible for:

  • Your applications, configurations, and how you use the Services
  • Providing required notices and obtaining consent from End Users where applicable
  • Compliance with all applicable laws and regulations
  • Implementing appropriate security, access control, and encryption for your use case

7. Node Operator responsibilities

If you operate resources, you must:

  • Provide accurate capability reporting and operational signals
  • Not falsify uptime/telemetry or manipulate integrity metrics
  • Not intercept or misuse traffic beyond what protocols require
  • Maintain secure systems and comply with applicable laws

We may restrict, quarantine, or remove resources that threaten integrity or availability.

8. Fees, billing, and taxes (if applicable)

If you purchase paid Services, fees and usage limits will be described in an order form, plan page, or written agreement. You are responsible for applicable taxes (excluding our income taxes).

9. Intellectual property

We and our licensors retain all rights in the Services, software, documentation, and trademarks. You receive a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

You may not reverse engineer the Services except where prohibited by law, nor remove proprietary notices.

10. Confidentiality (Business standard)

If you receive non-public information from us, you will protect it using reasonable care and only use it to evaluate or use the Services. Separate NDAs may apply.

11. Compliance, sanctions, and export

You may not use the Services in violation of export controls, sanctions, or other applicable laws.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability or that the Services will be error-free.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100 IF YOU PAID NOTHING.

14. Indemnification

You will indemnify and hold harmless the Operator and its affiliates, officers, directors, employees, and agents from claims arising out of your use of the Services, your Content, your applications, or your violation of these Terms or the AUP.

15. Suspension and termination

We may suspend or terminate access to protect the Services, enforce policies, or comply with law. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

16. Changes

We may update these Terms. Continued use after changes become effective constitutes acceptance.

17. Governing law; venue

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Venue for disputes will be state or federal courts located in Delaware, unless otherwise required by law.
